Wills, Harta Sepencarian and Land: What to Know

In brief
- A Muslim bequest is limited to one third of the net estate and not to heirs without the others' consent; the Wills Act 1959 applies to non-Muslims only.
- A widow or widower can claim harta sepencarian after a spouse's death, before the estate is divided by faraid.
- Both change how much land stays in the estate and whose names go on the title, so settle them early, before the family weighs a JV.
Before heirs can know how much land they inherit, two questions are often overlooked: did the deceased leave a will, and does the widow or widower want to claim harta sepencarian (matrimonial property)? The answers decide how much land actually stays in the estate, and whose names finally appear on the title.
This guide explains the limits on a Muslim bequest, the basics of a non-Muslim will under the Wills Act 1959, harta sepencarian claims after a death in Selangor, and why settling them early helps a family decide about a land JV. How to calculate faraid shares is in our faraid and inherited land guide. General information only, not legal or religious advice. Consult a lawyer, a syarie lawyer or the Syariah Court about your case.

Muslim wills (wasiat): limits and conditions
Section 2 of the Muslim Wills (State of Selangor) Enactment 1999, as quoted by E-Faraid MAIS, defines a wasiat as a declaration a person makes in their lifetime about their property or its benefit, for charity or any purpose allowed by Islamic law, to take effect after death. E-Faraid MAIS lists four pillars: the testator, the beneficiary, the property bequeathed, and the sighah (declaration).
Two main limits, according to E-Faraid MAIS:
- One third. A bequest should not exceed one third of the net estate, meaning after funeral costs and debts are paid.
- Not to heirs. A bequest to an heir does not take effect unless the other heirs consent after the testator’s death.
Some practical points:
- Written is safer. JAKESS says a verbal wasiat is easily disputed and needs strong evidence such as oaths and witnesses.
- Confirming the wasiat. In E-Faraid MAIS’s estate administration steps, if there is a wasiat, the heirs should apply for a confirmation order (perintah pengesahan wasiat) at the Syariah Court. According to JAKESS, claims about wasiat are heard under section 61(3)(b) of the Administration of the Religion of Islam (State of Selangor) Enactment 2003.
- MAIS services. E-Faraid MAIS publishes a fee of RM300 for writing and storing a wasiat and RM50 for each amendment. Check current fees with MAIS.
- The Wills Act 1959 does not apply to Muslims’ wills (section 2(2) of that Act).
Non-Muslim wills: the Wills Act 1959
For non-Muslims in Peninsular Malaysia (section 1(2)), the Wills Act 1959 [Act 346] sets the basic rules. In brief:
- Age of majority. A will made by a person below the age of majority is not valid (section 4).
- In writing, two witnesses. A will must be in writing, signed at the end by the testator (or by another person in their presence and by their direction), in the presence of two or more witnesses present at the same time, and the witnesses sign in the testator’s presence (section 5).
- Witnesses cannot benefit. A gift to a witness, or to a witness’s husband or wife, is void as far as it concerns them; the rest of the will stands (section 9).
- Marriage revokes a will, except a will expressed to be made in contemplation of that marriage and some other exceptions (section 12).
- Revocation only by marriage, a new will, a written revocation executed like a will, or destroying the will with the intention of revoking it (section 14).
The effect on the estate route: according to MyGOV and JKPTG, a non-Muslim estate with a valid will does not go to the small estate unit. It goes to the High Court for probate. Without a will, the property is divided under the Distribution Act 1958. See letters of administration and probate.
| Muslim wasiat (Selangor) | Non-Muslim will (Act 346) | |
|---|---|---|
| Law | Muslim Wills (State of Selangor) Enactment 1999 and Islamic law | Wills Act 1959 (Peninsular Malaysia) |
| Limit on amount | Should not exceed one third of the net estate | Act 346 sets no one-third limit; other laws may apply, consult a lawyer |
| To heirs | Only takes effect if the other heirs consent after the death | Act 346 has no such restriction |
| Form | Verbal or written; written is easier to prove | Must be written, two witnesses present together |
| Confirmation | Confirmation order, Syariah Court | Probate, High Court |
Harta sepencarian: the claim comes before faraid
Harta sepencarian is property acquired jointly by husband and wife during the marriage. According to JAKESS, it is divided based on each spouse’s contribution, direct and indirect, during the marriage. A spouse who did not work can also claim: the court looks at indirect contributions such as caring for the children and husband and efforts in looking after the property.
After a death
A Bernama Tinta Minda article (2021) cites Practice Direction No. 5 of 2003 of the Syariah Judiciary Department Malaysia (JKSM), which allows a harta sepencarian claim during or after a divorce, or after the death of either spouse. According to the article, the claim is made after funeral costs and debts are settled, and before the estate is distributed. E-Faraid MAIS places the step “identify any harta sepencarian claim” before bequests and faraid.
In Selangor
- Court: JAKESS says harta sepencarian claims are heard in the Syariah High Court.
- Sulh: harta sepencarian is one of the case types that can go through sulh (mediation). JAKESS states a maximum of 90 days to reach agreement; if it succeeds, the court records the settlement the same day without a trial. The Penang Syariah Judiciary Department explains that a sulh agreement is recorded as a court order.
- Evidence: prepare documents showing when and how the land was acquired, such as the title, the sale and purchase agreement, loan repayment records, and evidence of the spouse’s contribution.
How this changes the land in the estate
The order listed by E-Faraid MAIS decides how much land is left for faraid:
- The deceased's property Everything in the deceased's name on the date of death.
- Funeral and debts Paid first.
- Harta sepencarian The widow's or widower's share is taken out if claimed.
- Bequest Carried out within the limit.
- Faraid Only the remainder is divided among the heirs.
Hypothetical example: 3 acres with a harta sepencarian claim and a bequest, worked step by step
Example: 3 acres with harta sepencarian and a bequest (hypothetical)
Encik Zainal and his wife bought 3 acres during their marriage, registered in Encik Zainal's name. He dies with no debts, leaving his wife, two sons and one daughter, and a written wasiat giving 0.5 acres to a charitable body.
Harta sepencarian: the widow claims, and through sulh the family agrees 1 acre is her matrimonial share. The remaining estate: 2 acres.
Bequest: one third of 2 acres is about 0.667 acres, so the 0.5-acre bequest is within the limit. The remainder for faraid: 1.5 acres.
Faraid: widow 1/8 = 0.1875 acres. The remaining 7/8 (1.3125 acres) goes to the children at 2 : 2 : 1: each son 0.525 acres, daughter 0.2625 acres.
The result: the widow holds 1.1875 acres, the charitable body 0.5 acres, and the children the rest. Total: 1.1875 + 0.5 + 0.525 + 0.525 + 0.2625 = 3 acres. The harta sepencarian figure here is only an illustration; the real figure depends on agreement or the court's decision.
Notice two things in this example. First, the widow becomes the largest shareholder, something the family would not see if it only calculated faraid. Second, the beneficiary of the bequest (the charitable body) also has an interest in the land, and needs to be part of the discussion if the land is to be developed.
Why settle these early, before weighing a JV
- Every registered owner must agree. An agreement covering the whole lot usually needs every co-owner’s signature. See inherited land with many heirs.
- An unresolved claim holds everything up. While a harta sepencarian claim or a dispute over a will is running, estate distribution and dealings in the land are usually on hold.
- Shares decide how proceeds are split. A schedule for sharing JV proceeds among owners follows the shares on the title, or the written agreement of all owners. That schedule can be included in the agreement.
- Time does not wait. If another heir dies before this is settled, the estate becomes layered and more names must agree.
- A more accurate feasibility study. A developer assesses land based on its title and official search. Check the documents for a feasibility report.

Questions
Is a verbal will valid?
According to JAKESS, a wasiat can be expressed verbally or in writing, but a verbal one is easily disputed and needs strong evidence such as oaths and witnesses. For non-Muslims, section 5 of the Wills Act 1959 requires a written will signed in the presence of two witnesses present at the same time.
Can a Muslim bequeath land to their child?
According to E-Faraid MAIS, a bequest to an heir does not take effect unless the other heirs consent after the testator's death. A bequest to a non-heir should not exceed one third of the net estate.
When can harta sepencarian be claimed after a death?
According to a Bernama Tinta Minda article (2021) citing JKSM Practice Direction No. 5 of 2003, a claim can be made after one spouse's death, after funeral costs and debts are settled and before the estate is distributed.
Which court hears harta sepencarian claims in Selangor?
According to JAKESS, harta sepencarian claims are heard in the Syariah High Court. They can also be settled through sulh (mediation), with a maximum of 90 days to reach agreement.
Can a wife who did not work claim harta sepencarian?
Yes. According to JAKESS, the court looks at the wife's indirect contribution during the marriage, such as caring for the children and husband and her efforts in looking after the property.
Does marriage revoke a non-Muslim will?
Generally, yes. Section 12 of the Wills Act 1959 says a will is revoked by the testator's marriage, except a will expressed to be made in contemplation of that marriage, and some other exceptions.
